Terms and Conditions

  1. PMG Technik GmbH (DE 312658185, Berlin Charlottenburg HRB 187627) – the Seller, grants a warranty for the proper functioning of the gearbox and other goods. The goods sold are free from material and legal defects. For consumers, the general consumer protection provisions apply.
  2. These General Terms and Conditions (GTC) apply to all purchase agreements concluded with the Buyer. Deviations from or additions to these GTC must be made in writing in order to be valid; otherwise, they shall be null and void.
  3. The Buyer shall receive these GTC at the latest upon placing the order. The GTC are also available online at: http://info.pmgtechnik.com/agb
  4. The Seller retains ownership of the goods until the return of the exchanged item, and this applies only in the case of purchases made under the exchange program, i.e. overhauled/regenerated goods exchanged for the Buyer’s used item. Ownership is therefore transferred under the suspensive condition that the used item is returned (retention of title). The used item must be made available to the Seller, ready for collection, within 21 days. The return of the used item shall be carried out by the carrier UPS, designated by the Seller. Until the used item is handed over, the Buyer is only a possessor of the goods, not the owner. The retention of title does not apply to goods that are not offered under the exchange program.
  5. Our loan containers (original packaging) are intended exclusively for our products and may not be used for any other purpose. They must be used to send your used exchange item back to us. They must be returned, in perfect condition, freight prepaid, together with the exchanged item, within 21 days as part of the exchange program. Otherwise, we will charge a flat fee of 20 euros, which will be offset against any potential claims for damages.
  6. The Buyer has the right to return the goods (right of withdrawal). You have the right to withdraw from the purchase contract without giving any reason within:
    1. 90 days, in the case of purchasing a PREMIUM product, i.e. all gearboxes or reinforced intake manifolds; the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, have taken possession of the PREMIUM product.
    2. 30 days, in the case of purchasing a STANDARD product, i.e. intake manifolds or repair kits; the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, have taken possession of the STANDARD product. In each case, the goods must be returned in an undamaged condition. You must make the goods available for collection without undue delay and in any event no later than fourteen (14) days from the day you inform us of your decision to withdraw from this contract. The deadline is met if the goods are ready for collection before the fourteen-day period expires. We bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
    3. To exercise your right of withdrawal, you must inform us – PMG Technik GmbH, Berlin, Joachimsthaler Strasse 15/8, 10719 Berlin – by means of an unambiguous statement (e.g. a declaration in text form via info.pmgtechnik.com, a letter sent by post, fax, or e-mail) of your decision to withdraw from the purchase contract. You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient to send the notification before the expiration of the above-mentioned period.
    4. Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen (14) days from the day on which we received your notification of withdrawal. We will use the same payment method as you used in the original transaction unless otherwise expressly agreed; you will not be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied proof of having sent back the goods, whichever is earlier.
  7. After withdrawal or within the exchange program, the goods or the used item will be collected free of charge by the designated UPS carrier. At info.pmgtechnik.com you can set all collection details yourself (date, location).
  8. In the event of a delayed withdrawal (after the expiry of the 90 or 30-day period), a reversal of the purchase contract may be agreed separately between the parties. In such cases, you shall bear the costs arising from the reversal of the contract, in particular the transport costs of returning the goods to the seller, in accordance with the current tariffs of the UPS carrier.
  9. The warranty applies as follows:
    1. 1 year for STANDARD goods sold to business customers (B2B),
    2. 3 years for STANDARD goods sold to consumers (B2C),
    3. 3 years for PREMIUM goods – gearboxes,
    4. 3 years for PREMIUM goods – reinforced intake manifolds.
    5. The warranty begins on the day the goods are received. The warranty is valid for the above-mentioned period without mileage limitation. In the case of consumer sales, the general provisions of the BGB and EU law apply.
  10. Handling instructions for goods: each gearbox must be installed carefully and professionally, as follows:
    • Fill in the oil through the hose until it overflows = maximum quantity reached (information available anytime via info.pmgtechnik.com);
    • Do not pull the gearbox at the selector lever;
    • Check that the cables are properly adjusted and not worn;
    • Do not start the vehicle on a lift where the wheels are hanging freely;
    • When the vehicle is started for the first time after gearbox installation, it must idle for 10 minutes (CAUTION! Do not engage gears during this time);
    • All other work related to gearbox replacement must be carried out in accordance with automotive repair principles and by qualified personnel.
  11. If any damage or defects of our goods are detected during the warranty period, the Buyer must immediately contact the Seller before undertaking any actions (disassembly, installation, collection, or other repairs), primarily via our PMG platform for quick technical assistance [info.pmgtechnik.com] (registration required). Other communication methods (e-mail, fax, phone) are not excluded.
  12. The gearbox must be delivered to the Seller in its complete condition (together with the drained gearbox oil in an appropriate container), properly packed to protect it against transport damage. A copy of the invoice must be attached.
  13. The complaint will be examined exclusively in the Seller’s service facility. In case of dispute, an independent expert may be appointed to confirm or deny the existence of product defects. The costs of the expert opinion shall be borne equally by the Seller and the Buyer. In the case of gearboxes and other goods, the Seller undertakes to cover the necessary and reasonable costs of removal and installation as well as shipping costs in connection with supplementary performance in accordance with § 439 BGB.
    For consumers (B2C), the statutory provisions apply without restriction.
    For business customers (B2B), reimbursement of the above-mentioned costs is limited to 30% of the purchase price of the affected product.
  14. The complained-of goods (gearbox, intake manifold) must be made available to the Seller for collection at the location where they are situated at the time the complaint is filed. A Buyer entitled to make a complaint must grant the Seller or a UPS carrier designated by the Seller free access to the complained-of goods (on-site) for transport, inspection, verification, or assessment. If access is wrongfully denied, the basis for liability lapses. A detailed description of the defect and the circumstances under which it occurred must be provided to the Seller. Given the nature and characteristics of the goods – particularly gearboxes, which cannot be thoroughly inspected on site – the Buyer is obliged to place the gearbox in a safe location, ready for collection by the UPS carrier. At info.pmgtechnik.com you can specify all collection details (date, location) and upload your defect description.
  15. Within three (3) working days after the complained goods have been delivered to the Seller, an expert report shall be issued, either in text form or in writing. This report shall in every case be presented to the person who filed the complaint.
  16. If it is determined, based on the expert opinion, that the gearbox is free from defects, the person who filed the complaint (Buyer) shall bear all transport costs.
  17. If it is determined, based on the expert opinion, that the gearbox has defects, the person who filed the complaint (Buyer) shall be entitled to the rights mentioned above.
  18. The Buyer shall receive, as rectification, the repaired gearbox or another equivalent refurbished gearbox free of defects (supplementary performance – removal of defect or delivery of a defect-free item – exchange). These services shall be provided at the Seller’s discretion.
  19. Shipment shall be carried out within 7 working days from the date on which the defect of the delivered gearbox was confirmed in our expert report. An extension of this period up to 14 working days may be reserved by us in exceptional cases.
  20. If it is determined, based on the expert opinion, that the gearbox was damaged as a result of, and in particular due to, the following:
    • mechanical damage or defects caused by improper handling; non-compliance with the storage, processing, assembly, usage, or maintenance requirements as specified in the instructions provided by PMG;
    • improper installation;
    • incorrect use;
    • inadequate maintenance;
    • damage resulting from normal wear and tear;
    • damage caused by exposure to aggressive substances, such as cleaning agents;
    • self-performed modification or repair (self-help repair), especially if such modification or repair violates the accepted state of the art or European standards or regulations — in such case, the person who filed the complaint (Buyer) shall be informed, primarily via our PMG quick technical assistance platform [info.pmgtechnik.com], and subsequently in writing, by telephone, or by e-mail, of the repair costs of the gearbox, transport costs, and other expenses (hereinafter referred to as “out-of-warranty costs”).
  21. If the person who filed the complaint (Buyer) agrees in writing, or via our PMG quick technical assistance platform, or by e-mail, to the out-of-warranty costs, the complained and repaired gearbox, or another equivalent refurbished gearbox, shall be delivered to them. Shipment shall be carried out within 7 working days from the day the Buyer has accepted the incurred costs. An extension of this period up to 14 working days may be reserved by us in individual cases.
  22. If the person who filed the complaint (Buyer) does not agree to the out-of-warranty costs, the Seller shall be released from any warranty liability. The Buyer is then obliged to collect the goods. The collection date of the complained gearbox must be arranged in advance via our PMG quick technical assistance platform.
  23. The warranty does not cover any costs associated with a breakdown, such as:
    • the vehicle cannot be driven;
    • loss of time;
    • loss of vacation;
    • fuel costs;
    • telephone calls;
    • business trips;
    • accommodation;
    • lack of alternative means of transport;
    • damage to personal belongings;
    • commercial losses;
    • loss of income;
    • loss of profit.
  24. Stickers / security labels on the goods and other seals must not be damaged or removed. Any damage preventing clear reading of the symbols or warranty colors results in the loss of warranty rights.
  25. The warranty expires after the end of the warranty period or by a final and binding court judgment.
